Agreement to Terms

Welcome to Alpinecast. These Terms and Conditions ("Terms") govern your use of the Alpinecast mobile application ("App", "Service") operated by George Leonardo ("we", "us", "our").

By downloading, installing, or using Alpinecast, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

Please read these Terms carefully before using our App.

License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on devices you own or control
• Use the App for personal, non-commercial purposes
• Access snow forecasts and weather information for your personal use

Restrictions

You agree NOT to:

• Copy, modify, or create derivative works based on the App
• Reverse engineer, decompile, disassemble, or attempt to derive the source code
• Distribute, sublicense, rent, lease, or lend the App
• Use the App for commercial purposes without authorization
• Scrape, extract, or aggregate weather data for redistribution
• Circumvent any security or technological features
• Use the App in any way that could damage or impair it
• Attempt to gain unauthorized access to the App or its systems

Weather Data and Forecasts

IMPORTANT: Weather forecasts are predictions and may not be accurate.

You acknowledge and agree that:

• Weather forecasts are estimates and can change rapidly
• Snow forecasts may not reflect actual conditions at ski resorts
• You should verify conditions with official resort sources before traveling
• Weather data is provided by third-party services and may contain errors
• We are not responsible for inaccurate forecasts or outdated information
• Mountain weather can be unpredictable and dangerous

DO NOT rely solely on Alpinecast for safety decisions. Always check current conditions and follow official safety guidelines.

Safety and Recreational Use

Alpinecast is a forecast and information tool only. It is not a substitute for:

• Official avalanche forecasts and safety bulletins
• Professional weather services
• Resort-provided condition reports
• Professional avalanche safety training
• Common sense and good judgment

Mountain activities carry inherent risks. You are solely responsible for your safety and decisions while engaging in winter sports and mountain activities.

Intellectual Property Rights

The App and its original content, features, and functionality are owned by George Leonardo and are protected by international copyright, trademark, and other intellectual property laws.

Weather data is provided by third-party services and remains the property of those services. Resort names and information are the property of their respective owners.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to:

• Warranties of accuracy, reliability, or timeliness of weather data
• Warranties that forecasts will be correct or up-to-date
• Warranties that the App will be uninterrupted or error-free
• Warranties of merchantability and fitness for a particular purpose
• Warranties regarding data availability or network connectivity

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF THE APP.

This includes, but is not limited to:

• Personal injury or property damage
• Damages arising from inaccurate weather forecasts
• Losses resulting from travel decisions based on forecast data
• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Business interruption or missed opportunities

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such cases, our liability will be limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless George Leonardo from any claims, liabilities, damages, losses, costs, or expenses arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Decisions you make based on forecast information
• Any activities or injuries resulting from your use of weather data

Third-Party Weather Data

Alpinecast uses weather data from third-party providers. You acknowledge that:

• Weather data may be subject to third-party terms of service
• Data availability depends on third-party service uptime
• We are not responsible for errors in third-party data
• Weather services may change or discontinue without notice

Apple App Store Terms

If you download the App from the Apple App Store, you acknowledge that:

• These Terms are between you and George Leonardo, not Apple
• Apple has no obligation to provide maintenance or support
• Apple is not responsible for claims relating to the App
• Apple and its subsidiaries are third-party beneficiaries of these Terms
• You must comply with applicable App Store terms

Updates and Modifications

We reserve the right to:

• Modify, update, or discontinue the App at any time
• Add or remove features, locations, or data sources
• Require you to install updates to continue using the App
• Change which weather data providers we use

We will not be liable for any modification, suspension, or discontinuance of the App.

Termination

We may terminate or suspend your access to the App immediately, without prior notice, if you breach these Terms.

Upon termination, you must delete all copies of the App from your devices. Provisions that should survive termination will remain in effect, including disclaimers, limitations of liability, and indemnification.

Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any disputes shall be resolved in courts of competent jurisdiction.

Severability

If any provision of these Terms is found to be unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and George Leonardo regarding use of the App.

Changes to These Terms

We may update these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the App after changes constitutes acceptance.
